Delaware Decriminalizes Marijuana

On Friday, December 18th, Delaware legalized the possession of small amounts of marijuana. Delaware now joins the other 18 states that have removed the criminal penalties for possessing cannabis.

The state legislature passed the bill in June to remove the harsh criminal penalties for possession of under an ounce of marijuana. Previously, the drug was punishable with up to three months in jail. It is now only a civil violation like a fine or a traffic ticket.

The bill does not, however, legalize the substance. People are expected to use it in the privacy of their own homes cloud collaboration. Smoking in public remains illegal and is punishable by less than a year in jail as well as a misdemeanor charge.

Harsher prosecution of marijuana possession is reserved for teenagers and young adults under the age of 21, for whom a second offense will draw an “unspecified misdemeanor” charge and a $100 fine. After they turn 21, they can petition to have their conviction expunged.
